Pageant of Lights 2023 Terms and Conditions

The following terms and conditions apply to ALL Pageant of Lights Parade applicants and participants: -

1.    GENERAL 
(a)    Participants acknowledge that any failure on their part to comply with the terms and conditions and/or Parade Rules (clause 5) may result in their exclusion from participation in the Parade, immediately and it the future. 
(b)    It is the responsibility of the person lodging the Application to ensure that they, and all participants for that group are aware of and willing to comply with the terms and conditions and Parade Rules.
(c)    Entry in the Parade is voluntary, no entry fee is charged and no payment for entry is given. 
(d)    The Parade is a festive occasion and not to be used to promote religious or political purposes. 
(e)    The Parade is a fun family event, and no inappropriate behaviour will be tolerated from participants. 
(f)    Participants must at all times promptly comply with instructions given by Council, the Parade Officials appointed by Bundaberg Regional Council and members of the Queensland Police Service. 
(g)    Vehicles and/or floats participating in the Parade must be listed in the Application and approved by Council. 
(h)    Participants must take all reasonable steps to preserve their own personal safety and must take care when travelling as passengers on any vehicle or float to avoid all risk of falling. 
(i)    Participants acknowledge and agree that images or recordings created of them in connection with the Parade may be used, published or reproduced by Council, its agents and in any form (in whole or part) and by any medium, including but not limited to websites and social media.
(j)    All drivers must obey by all road rules and might be asked to participate in a drug and alcohol test. 

2.    INDEMNITY & RISK 
(a)    Vehicles and participants participate in the parade at their own risk. 
(b)    Participants indemnify Council against:
(i)     any claim by any person (including corporations) in respect of personal injury, disease, death or illness; 
(ii)    Any loss arising from the participant’s breach of these terms and conditions; 
(iii)    Any claim in respect of loss to property; and 
(iv)    Any loss arising from the participant’s negligence or its employee’s negligence except where is caused or contributed by Council.
(c)    Council does not accept any responsibility for any damage or loss to participants or to your business/property. 

3.    INSURANCE & REGISTRATION 
(a)    Public Liability insurance cover to the amount of $20 million is compulsory. A copy of a current Certificate of Currency must be included with your application and be valid for the Parade. 
(b)    Each vehicle and/or float must be insured with Motor Vehicle Insurance. A copy of your current Certificate of Currency must be included with your application and be valid for the Parade.
(c)    Vehicles must be registered or have a permit and must be driven by a current driver’s licence holder. Holders of Learners Permits will not be permitted. 
(d)    If you have not provided copies of Certificates of Currency, you will not be permitted to participate in the Parade.

4.    BAN OF HELIUM BALLOONS, PLASTIC STRAWS & OTHER MANUFACTURED PRODUCTS
(a)    Council’s Local Law No. 3 – Community and Environmental Management prohibits the release of helium balloons. In an effort to minimise environmental effects which could impact out local marine life and in order to set a positive example for the community, helium balloons, plastic straws, confetti, glitter, streamers and other manufactured products will not be permitted at the Parade.  

5.    PARADE RULES 
(a)    Participants must suitably display Christmas spirit. 
(b)    All vehicles in the Parade must be ‘special’ or ‘decorated’ vehicles of high standard. 
(c)    All signage, decorations, furniture and other items on a vehicle or float must be securely attached to that vehicle or float. 
(d)    All entrants need to be mindful of the size, width and height of their float/vehicle to ensure they can safely manoeuvre the entire Parade route without hindrance.  Failure to comply may result in you not being able to participate.
(e)    All participants must accept their allocated position in the Parade and follow the instructions of the Parade Officials at all times.
(f)    Each entrant will be limited to 1 vehicle (i.e., 1 vehicle or 1 vehicle towing trailer) participating in the parade.
(g)    Walking groups are permitted forward manoeuvres only. 
(h)    A spacing of 15 metres between each float/group is required.
(i)    All floats/groups are required to close the gap between participants when asked by Parade Officials and to please be aware of the gap behind you;
(j)    Alcoholic beverages are strictly forbidden on any float, in any vehicle or on the person of any participant; 
(k)    The Parade Official’s instructions must be obeyed at all times.
(l)    Council’s and the Parade Official’s decision regarding all entries is final and no correspondence will be entered into.
(m)    The safe maximum height for floats/entrants is 3 metres due to low lying branches in the Parade route.  Please do not exceed this height as it may cause a safety issue.
(n)    For safety reasons - throwing or handing of items (e.g. lollies, brochures etc) or using bubbles from floats and/or walking participants, is NOT PERMITTED under any circumstances (excluding Santa’s float).  Offenders may be removed from the Parade.  Bundaberg Regional Council encourages patrons to distribute any items in the Event area at the completion of the Parade.
(o)    It is requested that only the final float will carry Santa (provided by Bundaberg Regional Council). Santa is not to be displayed by any other participant.
(p)    It is the responsibility of those with animals as a part of their entry, to ensure they are under their control and no mess is left behind them.  Ensure any mess is cleaned up immediately.
